Terms & Conditions
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Arvind Vijayendiran, doing business as Kani Tales (“Kani Tales”, “we”, “us”, or “our”), and you (“User”, “you”, or “your”). These Terms govern your access to and use of the Kani Tales web application, website, and related digital services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
Who We Are & Contact Information
Eligibility & Parental Responsibility
- Adult Registration Required: The Service is intended for purchase and administration by adults. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account, initiate free generations, or purchase a subscription.
- Supervision of Minors: Toddlers and young children may only interact with or consume content from the Service under the direct supervision and guidance of a parent or legal guardian.
- Parental Responsibility: The supervising adult is solely responsible for:
- All account activity and security.
- All inputs provided (including child names, pet names, and optional photos).
- Reviewing all generated story text and illustrations before sharing them with a child.
Account Registration & Security
- Account Credentials: You may register an account using your email and password or via Google Sign-In. You must provide accurate, current, and complete information and maintain the confidentiality of your login credentials.
- Account Integrity: Each user may maintain only one active account. Automated registrations, bots, or shared multi-user accounts are strictly prohibited.
- Security Notification: You agree to immediately notify us at
support@kanitales.zohodesk.inif you detect or suspect unauthorized access to your account. - Account Deletion: You may permanently delete your account and associated child profiles at any time through your in-app Account Settings.
Nature of the Service & AI Disclaimers
- Generative AI Operations: Kani Tales is an automated, AI-powered storytelling service. Stories and illustrations are generated using external artificial intelligence systems (OpenAI and Leonardo AI).
- Probabilistic Outputs: Outputs are generated algorithmically and are not reviewed by humans prior to delivery. While we enforce automated content filtering, AI-generated outputs may occasionally be inaccurate, unexpected, or inconsistent with your expectations.
- Adult Pre-Screening Duty: You acknowledge and agree that you must inspect and evaluate all generated story text and illustrations before presenting them to a child.
- No Professional Reliance: Generated stories are works of fiction intended solely for entertainment and family enjoyment. Outputs must not be relied upon as factual knowledge, educational curriculum standards, or medical/psychological guidance.
Free Generations, Subscriptions & Billing
A. Freemium Tier (Free Stories)
- Kani Tales offers up to two (2) free generated stories per account upon registration to allow users to evaluate the Service.
- Payment card details are not collected for these free story generations.
- We reserve the right to limit, modify, or revoke the free generation tier if we detect abuse or duplicate account creation.
B. Recurring Subscriptions
- Beyond the free stories, continuous access to story and illustration generation requires an active paid subscription (available on monthly or annual billing cycles).
- Automatic Renewal: Unless canceled prior to the end of the current billing cycle, your subscription will automatically renew for the same duration at the then-current standard rate.
C. Merchant of Record & Payment Handling
- All payment processing, invoicing, and subscription billing are handled exclusively via our merchant of record, Dodo Payments.
- By purchasing a subscription, you authorize Dodo Payments to charge your selected payment method on a recurring basis. Kani Tales does not collect, store, or process raw credit/debit card numbers.
- Subscription pricing is clearly displayed at checkout and includes or itemizes any applicable sales taxes or VAT based on your billing jurisdiction.
Cancellation & Refund Policy
A. Subscription Cancellation
You may cancel your subscription at any time through your account settings or the Dodo Payments customer billing portal.
Access Period: Upon cancellation, automatic renewal charges will cease. You will retain full access to paid subscription features until the end of your then-current paid billing period. No pro-rata or partial credits are issued for unused days during an active cycle.
B. 14-Day Refund Window (Zero Story Usage Only)
- Strict Non-Refundability Once Used: Because story and image generation consumes third-party computational and AI inference resources immediately upon request, subscriptions are strictly non-refundable once digital story or illustration generation has started.
- Eligibility for Refund: You may request a full refund within fourteen (14) calendar days of your initial subscription purchase only if zero (0) stories or illustrations have been generated on your account following the subscription transaction.
- Processing Refunds: Refund requests meeting this criteria must be submitted by emailing
support@kanitales.zohodesk.inwith your account email and Dodo Payments receipt number. Approved refunds are processed directly by Dodo Payments to your original payment method.
Intellectual Property & Content Ownership
A. Our Platform IP
Kani Tales and its licensors retain all right, title, and interest in and to the Service, including the underlying software code, web designs, user interfaces, branding, logos, trademarks, and visual assets. Except for the limited license granted herein, no rights are transferred to you.
B. User Inputs
You retain ownership of any text, names, descriptions, or optional photos you provide (“Inputs”). You grant Kani Tales a limited, non-exclusive, royalty-free, worldwide license to process, transmit, and adapt your Inputs solely to operate the Service, deliver generated outputs, and maintain security in accordance with our Privacy Policy.
C. Generated Outputs & Non-Commercial License
- Ownership: Subject to your full compliance with these Terms, you own the final AI-generated story text and illustrations produced specifically for your account (“Outputs”).
- Scope of Use (Personal, Non-Commercial): The license granted to use Outputs is strictly for personal, family, and non-commercial home use (e.g., reading at bedtime, printing copies for personal household keepsakes, or private family sharing).
- Commercial Restrictions: You may not commercialize, sell, license, distribute via paid channels, or publish Outputs as part of a commercial product, book, or merchandise without prior written authorization from Kani Tales.
- Non-Exclusivity: Because AI models operate probabilistically, similar or identical narrative motifs, phrasing, or artistic styling may be generated independently for other users.
Acceptable Use & Prohibited Conduct
You agree to use Kani Tales strictly in accordance with applicable laws and family safety standards. You must not:
- Abusive or Illegal Prompts: Input content that is illegal, defamatory, hateful, abusive, threatening, racially offensive, violent, or sexually explicit.
- Circumvention & Attacks: Attempt to bypass, disable, or tamper with our safety filters, content moderation systems, or system prompts (including prompt injection, jailbreaking, or adversarial inputs).
- Third-Party Rights Violations: Upload photos or submit names of individuals for whom you do not possess valid parental or legal guardian consent.
- System Tampering: Reverse engineer, decompile, scrape, spider, or interrupt the normal operation, infrastructure, or APIs of the Service.
- Commercial Reselling: Resell access to the Service, sub-license accounts, or provide generation services to third parties for commercial gain.
⚠️ We reserve the right to immediately suspend or terminate any account found in breach of this section without prior notice or refund.
Service Availability, Maintenance & Modifications
- Operational Changes: We reserve the right to enhance, alter, update, or temporarily suspend features of the Service to perform maintenance, ensure system security, or comply with legal mandates.
- Third-Party Infrastructure Dependencies: You acknowledge that the Service depends on cloud hosting and external AI inference vendors (e.g., Supabase, OpenAI, Leonardo AI). We are not liable for transient service interruptions, network downtime, or latency caused by external vendor outages beyond our reasonable control.
Disclaimers & Limitation of Liability
A. Warranty Disclaimer
To the maximum extent permitted by applicable law, the Service and all generated Outputs are provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
B. Limitation of Liability
To the maximum extent permitted by applicable law:
- Under no circumstances will Arvind Vijayendiran, Kani Tales, or our sub-processors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, goodwill, or personal inconvenience arising from your use of or inability to use the Service or any AI-generated Outputs.
- Our total aggregate liability for all claims arising out of or related to these Terms or the Service, regardless of the legal theory (contract, tort, or otherwise), shall not exceed the total amount you actually paid to Kani Tales during the twelve (12) months preceding the incident giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, fraudulent misrepresentation, wilful misconduct, or any mandatory consumer rights under applicable law.
Dispute Resolution & Governing Law
A. Mandatory 30-Day Informal Dispute Resolution
Before initiating formal legal action or court proceedings, you and Kani Tales agree to attempt to resolve any dispute, controversy, or claim amicably in good faith:
- You must first send a detailed written notice of your dispute to
support@kanitales.zohodesk.in. - Both parties agree to engage in informal discussions for a period of at least thirty (30) calendar days from receipt of the notice. Formal proceedings may not be commenced until this 30-day period has elapsed.
B. Governing Law & Jurisdiction
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by the laws of the Republic of India, without regard to its conflict of law principles.
Where permitted by applicable law, disputes may be brought before the competent courts of Chennai, Tamil Nadu, India. Nothing in these Terms limits or deprives consumers of any mandatory rights or protections, including any right to bring proceedings before the courts of their country of residence where such rights are provided by applicable consumer protection laws.
Miscellaneous Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete and exclusive agreement between you and Kani Tales regarding your use of the Service, superseding any prior agreements or representations.
- Severability: If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, reorganization, or sale of assets.
- Updates to Terms: We reserve the right to revise these Terms at our discretion. If changes are material, we will provide at least thirty (30) days' notice via email or a prominent notification on our website prior to the revised terms taking effect. Continued use of Kani Tales after the effective date constitutes your binding acceptance.
